General conditions

Article 1. Applicability of the general terms and conditions.

All offers, quotations, agreements and other services provided by Move Limitless are subject to these terms and conditions. These terms and conditions apply to all members of Move Limitless. Members are deemed to have approved the terms and conditions when purchasing a turn card or subscription. They are considered to have read the terms and conditions before payment. Move Limitless is entitled to modify and/or supplement the terms and conditions and house rules.

Article 2. Membership.

Membership shall mean a membership for a definite period of time in which it is possible to participate in group classes, challenges, personal training sessions and duo workouts belonging to the purchased membership.

Article 2a. A membership can be entered into by signing up through the Move Limitless website, through the online enrollment system Virtuagym or on site at one of the coaches. Customers wishing to become members purchase a turn card or class series, where they receive a login. With that login, members make reservations for group classes. For the challenges, personal training sessions and duo training sessions, members sign up for a set series of classes and reservations per class are not required.

Article 2b. Membership starts on the day of purchase of subscription or turn(s). The member owes the membership fee from the start date and pays it online or at the start of the first lesson.

Article 2c. A membership is strictly personal and non-transferable.

Article 2d. As a result of failure to fill out the registration form truthfully, a participant may be refused participation in classes in Move Limitless

Article 2e. Move Limitless is authorized to refuse persons and/or unilaterally terminate their subscription(s) without refund of subscription fees and/or monies due for failure to comply with house rules.

Article 3. Cancel membership fees and group class registration.

Each member pays membership fees belonging to the type of membership chosen. Move Limitless periodically determines the price of new membership fees.

Article 3a. Payment of membership is made according to the agreement made between Move Limitless and the member. The cost of membership shall be paid immediately by the member to Move Limitless.

Article 3b. A member may unsubscribe free of charge until 2 hours before the start of a group lesson in Arenal for which he or she had signed up. Until then, in case of a turn card, the turn will be automatically reinstated on the card. If a member cancels a group lesson for which he or she was signed up after 2 hours before the start, then unsubscribing is not possible and the turn will expire. In this case, and in the member's absence, one turn will be deducted from the turn card. 

Article 4. Duration of Membership.

Membership is concluded for the chosen period and is not automatically renewed.

A turn card is strictly personal and is valid for as many weeks as the number of turns. That means a 5-turn card is valid for 5 weeks from the date of purchase, a 10-turn card is valid for 10 weeks from the date of purchase, and a 20-turn card is valid for 20 weeks from the date of purchase. An Unlimited subscription for Arenal's group exercise classes is valid for 1 month from purchase date. 

Article 4a. Membership cannot be paused by the member. Move Limitless can only put the membership on hold when the member cannot continue exercising due to medical reasons. The membership will never be put on hold because of a vacation.

Article 5. Termination of a membership.

Move Limitless reserves the right to terminate membership, regardless of the type of membership for cancellation without giving reasons in any of the following cases:

1. Without notice, if a member seriously and/or repeatedly violates the terms and conditions or house rules of Move Limitless, or misbehaves in the judgment of Move Limitless. There will be no refund of paid membership fees.
2. With a written warning in advance, if payments arising from membership remain unpaid 30 days after due date. Members cannot cancel membership themselves. Membership is current for the chosen period.

Article 6. Injuries/illness due to training.

In case of illness or an injury or other injury that makes participation in training no longer possible, membership can be temporarily suspended after permission from Move Limitless, except for injuries and/or illnesses of less than 1 week. Suspension can never be retroactive. 

Article 7. Risk and Liability.

Move Limitless is under the obligation, given the purpose of the training program, to guide the participant(s) as best as possible during the training. 

Participation in training at Move Limitless and other activities is entirely at your own risk.

Article 7a. Move Limitless is not liable for injuries or other damages that participants may incur during or as a result of any training or workouts.

Article 7b. Move Limitless is authorized to refuse participants during (parts of) workouts or to provide alternative workouts to prevent injuries.

Article 7c. Move Limitless is not liable if during a training or other activity, due to any cause, items belonging to the participant and/or third parties are lost in any way.

Article 7d. Move Limitless is not liable when the participant suffers damage in any other way and this damage is due to the participant's failure to follow verbal or written instructions, or the participant's physical or mental condition.

Article 7e. Move Limitless is liable, however, if the damage referred to above is the result of intentional or gross negligence on the part of Move Limitless. However, the liability is maximized to an amount equal to the membership fee over 12 months.

Article 8. Conduct of Members.

Members will not abuse the materials or facilities provided by Move Limitless. Any damage to property, caused intentionally or through identifiable fault, must be fully reimbursed by affected members. Incorrect, rowdy or aggressive behavior may result in termination of membership.
